1. Before Arraignment


Arraignment Within 48 Hours of Arrest

Defendants have the right to a speedy trial. [US Const Amend VI; Cal Const art I, §15 .] A timely arraignment is a part of his or her speedy trial rights. [PC §1382.]

Defendants must, in all cases, be brought before the court without unnecessary delay. Arraignments must occur within 48 hours unless that would fall at a time in which the court is not in session. [PC §825.] In that case, defendants must be arraigned on the next court day.
