§4.14 Life Insurance Generally

To the extent a life insurance policy is acquired with community assets, or earned during marriage in the case of employer-provided coverage, the policy is community property. [See Grimm v Grimm (1945) 26 C2d 173, 175.] The community interest in the proceeds is subject to the general rule that a spouse cannot dispose of community personal property without fair and reasonable compensation or the other spouse's written consent. [FC §1100(b).]
