What Do Tribes Do With Notice?
If the child in a custody proceeding is or may be an Indian child, ICWA notice to the concerned tribe or tribes:
- Enables them to determine whether the child is an Indian child as defined in ICWA; and
- Advises them of their rights to:
- Transfer the proceeding to tribal court,
- Intervene (i.e., appear as a party in the proceeding), or
- Participate in the case.
