What Constitutes Notice?

For details, see the resource Statutory Specifications for Notice. In general, ICWA notice means actual notice of three aspects of the child custody case (see In re Marinna J. (2001) 90 CA4th 731, 735):

• The scheduled proceeding;



• The possible legal consequences of the proceeding; and
  
  
• The recipient’s legal rights under ICWA (transfer, intervention, and participation).

When siblings are involved in a proceeding, notice must be sent for each child individually. (In re Miracle M. (2008) 160 CA4th 834, 839, 841, 846.)
