§2.05 Application for Alternate Date

A party requesting a separate trial on an alternate valuation date must give 30 days written notice to the other party. [FC §2552(b).] The moving party must use form FL-315 to apply for the separate trial and provide notice. [CRC 5.126(a).]

The application must be accompanied by a declaration that states [CRC 5.126(b)]

• The proposed alternate valuation date;
• Whether the proposed alternate valuation date applies to all or only a portion of the assets; if applicable to only a portion of the assets, the declaration must separately identify each such asset; and
• The reasons supporting the alternate valuation date.
