III. Methods of Division

§3.01 Court's Discretion

When dividing community property, you are vested with discretion to choose a method that is not only mathematically equal, but practical and equitable as well. [Marriage of Fink (1979) 25 C3d 877, 884-885; see FC §2550.]

Tip

You may make any orders you consider necessary to carry out the purposes of the Family Code governing the division of community property. [FC §2553.] You may also let the parties choose the actual method of division.
