§3.11 Arbitration

You may submit the issue of the character, value, or division of the community estate to judicial arbitration for resolution if [FC §2554(a); CCP §§1141.10 et seq.]:

  • The parties do not agree in writing to a voluntary division of the community estate, and
  • The total value of the community and quasi-community property in controversy does not exceed $50,000.

You may submit the matter to arbitration at any time you believe the parties are unable to agree on a division of the property. [FC §2554(b).]
