§6.05 Separate Debts

You must confirm all separate debts, including those debts incurred by a spouse during marriage and before the date of separation that were not incurred for the benefit of the community, to the spouse who incurred the debt, without offset. [FC §2625; see Marriage of Stitt (1983) 147 CA3d 579, 586, 588.]

After the community estate is divided, see FC §916 for the general liability of separate property for various debts incurred before or during marriage.
