§7.02 Assignment of Payments to Educated Party

When dividing community liabilities, do not divide any outstanding balance on a loan incurred during marriage for the education or training of a party. You must assign the loan payments to the party who was educated or trained, except when the parties expressly agreed in writing to the contrary. [FC §2641(b)(2), (e).]
