§8.02 Date Property Acquired

The applicability of FC §2640(b) is limited by due process to property acquired on or after January 1, 1984. [Marriage of Heikes (1995) 10 C4th 1211, 1225.] For property acquired before 1984, a spouse is entitled to reimbursement only if the parties had so agreed; otherwise any contribution of separate property to the community property estate is considered an outright gift.
