§2.02 Public Assistance

Income derived from any public assistance program, eligibility for which is based on a determination of need, is not included in the recipient parent's gross income. [FC §4058(c).] Public social service benefits and SSI benefits are need based and may not be used to satisfy an existing support obligation.
