§4.07 Social Worker’s Report

Although it may contain hearsay, a social study report and its attachments are admissible as competent evidence on which to base your findings if the preparer is present for cross-examination and the parent or guardian has the opportunity to subpoena and cross-examine the witnesses mentioned in the report. [WIC §355(b), (d); CRC 5.684(c).]

The report must be provided to all parties or their counsel within a reasonable time before the jurisdiction hearing. Otherwise you may grant a continuance not to exceed 10 days. [WIC §355(b)(3).]
