§5.03 Notice of Hearing

If the hearing was continued, you must determine if required notice was given, and make a finding in the minutes. [CRC 5.534(l); see Part 2, §4.04.]

You should ensure that notice includes the educational representative for the child, if there is one. [WIC §319(g); CRC 5.650(j).]

If you know or have reason to know that an Indian child is involved, you must ensure that proper notice was given in compliance with the Indian Child Welfare Act (ICWA). [WIC §§224.2, 224.3, 291(g); CRC 5.481; see form ICWA-030; see also Part 1, §1.05.] ICWA applies to all proceedings involving Indian children that may result in an involuntary foster care placement. [25 USC §§1901–1923; [WIC §§224, 224.2; CRC 5.480.]
