Any person who is at least 18 years of age (or a legally emancipated minor) may be a party to a small claims action. [CCP §116.410(a).] A “person” is an individual, a corporation, a partnership, a limited liability partnership, a limited liability company, a firm, an association, or another entity. [CCP §116.130(e).] A party is either a plaintiff or a defendant. [CCP §116.130(g).]
A minor or an incompetent person may appear through a guardian ad litem who was appointed by a judge of the court in which the action is filed. [CCP §116.410(b).] For a list of individuals who can appear at the hearing on behalf of a corporation, an association, or other entities, see §5.06.
