Before the hearing, you or the clerk should ascertain whether there is adequate proof of service for each defendant and whether the service was timely made. If service was by mail with a return receipt, the return receipt must have been signed. [CCP §116.340(d).] Even if there are proof of service issues, the case may proceed if the defendant shows up. You may try to resolve service issues at the beginning of the calendar.
