§3.04 Waiver of Excess

If your court lacks jurisdiction solely because a party’s demand exceeds the applicable monetary jurisdictional limit, the party may waive the amount in excess, but the waiver is not operative until judgment. [CCP §116.220(d).]

Costs are not included within the jurisdictional limit because you award them only to the prevailing party in the judgment. [CCP §§116.610(g)(1), 116.820(c).]
