Ruben owns an apartment house. In March 2006, he filed an action in small claims court against a tenant for $2600 of damages in excess of the security deposit. In May 2006, he filed a small claims action against another tenant seeking $3000 on the same ground. In August 2006, he files another action against a third tenant on the same ground for $2800. The August 2006 action should be dismissed because it’s Ruben’s third small claims action in calendar year 2006 that demands more than $2500. Ruben must waive the $300 excess for the August claim or dismiss the action.
