§4.01 Defendant’s Claim

The defendant may file a claim against the plaintiff in the same action, but the claim may not exceed the jurisdictional limit of $5000, or $7500 if the defendant is a natural person. The defendant is also limited to no more than two claims that exceed $2500 in each calendar year. [CCP §§116.221, 116.360(a); see §§3.01, 3.05.]

The defendant’s claim does not have to relate to the same subject or event as the plaintiff’s claim. [CCP §116.360(a); CRC 3.2104.]
