§4.02 Service of Defendant’s Claim

The defendant must file and serve his or her claim on the plaintiff in the same manner as required for the plaintiff’s claim [CCP §116.360(b); see §§2.08 et seq] except for the time of service [CCP §116.360(c)].

• A copy of the defendant’s claim and order generally must be served on the plaintiff at least 5 days before the hearing date.
• If the defendant was served 10 days or less before the hearing date, a copy of the defendant’s claim and order must be served on the plaintiff at least one day before the hearing date.
