§4.05 Ruling on Request to Transfer

In ruling on a request to transfer, you may do any of the following [CCP §116.390(c)]:

  • Render judgment on the small claims case before the transfer,
  • Not render judgment and transfer the small claims case, or
  • Refuse to transfer the small claims case on the ground that the ends of justice would not be served.

If you transfer the small claims action before judgment, the two actions are tried together in the transferee court. [CCP §116.390(c).] After deciding to transfer, you should direct your clerk to transmit all files and papers to the transferee court. [CCP §116.390(d).]
