§4.08 Amendment to Claim

If a claim has already been served, a plaintiff or defendant may file form SC-114 to amend the claim to change the party’s name. If the claim has not been served, the plaintiff should file an amended claim on the claim form or dismiss the claim and refile.

A plaintiff or defendant who wants to change the basis or amount of his or her claim should either file and serve an amended claim or dismiss and refile.
