When judgment is rendered or notice of entry of the judgment is mailed to the parties, the clerk must deliver or mail to the judgment debtor a questionnaire regarding the nature and location of any assets of the judgment debtor. [CCP §116.830(a); see form SC-133.]
If a judgment debtor does not either pay the judgment, appeal, or move to vacate the judgment, he or she must complete the form and have it delivered to the judgment creditor within 30 days after the notice of entry of the judgment is mailed. [CCP §116.830(b).]
If a judgment debtor files an appeal or moves to vacate the judgment, he or she must complete and deliver the questionnaire within 30 days after the delivery or mailing of a notice of dismissal of the appeal, a notice of entry of judgment on the appeal, or a notice of denial of the motion to vacate. [CCP §116.830(c).]
If a judgment debtor willfully fails to comply with the questionnaire requirements, the judgment creditor may request sanctions for contempt of court, including arrest and attorney fees. [CCP §116.830(d); see CCP §708.170.]
