Mr. and Mrs. Tomas, I’m going to make you pay back to the landlady part of the re-carpeting cost because your dog created a problem that couldn’t be solved any other way. On the claim for half of the $1800 dollar cost to replace the carpeting, I’ll begin by saying that tenants are not responsible for costs related to normal wear and tear. For example, any carpet’s color will fade over time, no matter how well it is taken care of. But in this case it was necessary to replace all of it because the carpet in the living room had to be replaced and the rest of it had to match. The cost of re-carpeting the living room was $900; since the original carpeting was ten years old and had probably only five more years of life, I’ll reduce that $900 figure by two-thirds, leaving $300 dollars. Because the stains in the living room created the need for total replacement, the Tomas’ should reimburse Mrs. Long for the remaining $900, less two-thirds, or $300 dollars. I believe Mrs. Long should be reimbursed for part of the $500 dollar Jiffy bill for the time spent to get stains out of the living room rug, and to clean the oven, I think $100 dollars is adequate. My judgment is that Mr. and Mrs. Tomas owe the plaintiff $700 dollars, which has already been paid in full by their $700 dollar security deposit. So that will be the decision of the court.
