§2.04 Proof of Security

In a claim for refund of a security deposit, you may accept proof of the deposit by “any credible evidence,” such as [CC §1950.5(o)]:

  • A canceled check,
  • A deposit receipt,
  • A lease indicating the requirement of a deposit as well as the amount,
  • Either party’s prior consistent statements or actions, or
  • A statement under penalty of perjury that satisfies the credibility requirements of EC §780.
