§2.09 Statute of Limitation

If there is a written lease, a tenant must bring a claim for the recovery of a security deposit within four years. [See CCP §§337(1), 337.2.] The statute begins to run from the breach (a landlord’s unlawful retention of the security deposit) or expiration of the tenancy, whichever is later. [See Trypucko v Clark (1983) 142 CA3d Supp 1, 7.] If there is no written rental agreement, presumably a two-year limitations period applies. [See CCP §339(1).]
