§4.09 Professional and Occupational Licensing—Penalties for No License

Any person who is engaged in a business or profession for which a license is required but acts without the license is liable to any injured party for treble the amount of damages awarded, not to exceed $10,000, plus costs and attorney fees at your discretion. [CCP §1029.8(a), (c).] The treble-damage penalty does not apply to any person who believes in good faith that he or she is properly licensed, or whose license has expired and can be renewed by paying renewal fees without applying and qualifying for an original license. [CCP §1029.8(d).]
