Lesson 5: Tort & Contract Law

You may compel specific performance of an obligation if the agreed counterperformance has been substantially performed, or its concurrent or future performance is assured. [CC §§3384, 3386.] You should grant specific performance only when the legal remedy (e.g., damages) is inadequate.
