An action under the Act must be tried in the county where (a) the buyer signed the contract, (b) the buyer resided when the contract was entered, (c) the buyer resides when the action is commenced, or (d) the goods have been affixed to real property. [CC §1812.10(a).] Generally the plaintiff must file an affidavit or verified complaint showing proper venue [CC §1812.10(c)], but some judges think that requirement is satisfied by the declaration under penalty of perjury on the small claims pleading form that venue is proper.
