Because of its summary nature, an unlawful detainer action is generally not suitable for trying complicated ownership issues. The court that is hearing an action to quiet title decides whether to combine the UD case with it. If the plaintiff holds a valid trustee’s deed, the UD proceeds and no cross-claims are allowed. The defendant must file a separate action for fraud or quiet title on the ownership issue.
