§1.04 Jurisdiction

Unlawful detainer cases are filed as either limited or unlimited jurisdiction cases; they cannot be filed in small claims court. [See CCP §116.220.] The options are:

• If the rent and damages claimed are $25,000 or less, the case is filed as a limited civil case. [CCP §§85(a), 86(a)(4).]
• If the rent and damages claimed are greater than $25,000, the case is filed as an unlimited civil case. [See CCP §88.]
