§1.11 Proper Defendant

The only “necessary” defendants in an unlawful detainer action are tenants and subtenants in “actual occupation” of the premises. [See CCP §1164.] Generally, landlords will serve a CCP §415.46 “prejudgment claim of right to possession” packet on any unknown occupants of the property in order to ensure a complete eviction. [See §5.02 for an explanation of this process.]
