Under CCP §1161, residential tenants have a nonwaivable right to the 3-day notice claiming a breach. A term of a residential rental agreement that waives this notice is unenforceable. [See CC §1953(a)(3), (4); Gersten Cos. v Deloney (1989) 212 CA3d 1119, 1128.] But this right does not extend to commercial tenants, who may validly waive or modify statutory notice. [See Folberg v Clara G.R. Kinney Co., Inc. (1980) 104 CA3d 136, 140.] |
