Local ordinances in some jurisdictions (e.g., Berkeley, Los Angeles, San Francisco, San Jose, Santa Monica, and West Hollywood) impose rent controls that limit a property owner’s options to evict. You should check your jurisdiction to see if there is a “just cause for eviction” ordinance, which would provide that a landlord may evict a tenant only in specified circumstances. In those jurisdictions landlords do not have the option of serving the tenant with a 30-day or 60-day no-cause notice to terminate. When a landlord is converting federally subsidized housing to market-rate housing, a special 90-day notice applies to tenants. [See §5.01.] |
