§3.05 Prohibited Assignment or Sublease

When a commercial or residential tenant breaches a covenant against assigning or subletting the property, a landlord may give notice under either CCP §1161(3) (for a curable breach) or CCP §1161(4) (for an incurable breach). Which code section the landlord chooses typically depends on his or her level of satisfaction with the tenant.
