§3.11 Other Claims
|
Other plaintiff claims may come before you:
- Eviction pursuant to sale of property: CCP §1161a permits the eviction of tenants holding over after the property is sold via an execution sale, an IRS sale, a foreclosure sale, an owner occupant voluntary sale, or certain other sales. CC §1946.1(d) (effective January 1, 2007) authorizes a 30-day notice to quit for a residential tenancy when the owner is selling the dwelling or unit to a bona fide purchaser who is a natural person or persons and when other requirements are met.
- Eviction of caretaker or property manager: Resident managers and others whose right of occupancy is part of their employment compensation may be terminated without notice after discharge. [See CCP §1161(1); Karz v Mecham (1981) 120 CA3d Supp 1, 4.]
