If the rental property is in a rent-controlled jurisdiction and the landlord evicts a tenant so that the landlord or his or her immediate relative can move into the unit, the landlord or relative must reside in the premises for at least six months. If you determine that the eviction was fraudulent, you may order the landlord to pay triple the cost of relocating the tenant back into the landlord’s property, and triple the amount of any increase in rent that the tenant had to pay elsewhere. In addition, you must award attorney fees and costs to the prevailing party. [See CC §1947.10(a).]
